The Backyard Market is an online venue that allows independent farmers and growers ("Sellers") to list farm products and allows buyers ("Buyers") to discover those listings, reserve items for pickup, and message Sellers. We are not a seller, reseller, grocer, distributor, or food producer. We do not grow, harvest, handle, package, store, transport, or deliver any food or farm product listed on the Platform. Every transaction for goods is solely between the Buyer and the Seller.
You must be at least 18 years old to create an account or complete a transaction. By using the Platform you represent that you meet this requirement.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE, THAT PRODUCTS ARE SAFE, OR THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BACKYARD MARKET AND ITS OWNER, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO ILLNESS, INJURY, OR LOSS ARISING FROM THE CONSUMPTION OR USE OF ANY PRODUCT PURCHASED THROUGH THE PLATFORM — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN SUBSCRIPTION FEES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless The Backyard Market and its owner and operators from any claim, demand, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your listings or products, your violation of these Terms, or your violation of any law.
Disputes over products, payments, pickups, or reservations are solely between the Buyer and Seller. We are not obligated to mediate, arbitrate, or resolve user disputes, though we may remove listings or suspend accounts at our discretion.
Farmer and Buyer subscriptions are billed annually at the rates shown at checkout. Subscriptions renew automatically until cancelled. You may cancel through your account; cancellation stops future renewals but does not refund the current term. We may change pricing with 30 days' notice.
We may suspend or terminate accounts that violate these Terms, post false or unlawful listings, or engage in fraud, harassment, or abuse — with or without notice.
We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in South Carolina, and you consent to personal jurisdiction there.
